Data center tax exemption in Arkansas
Arkansas data center sales and use tax exemption (Ark. Code 26-52-456)
Data center equipment, eligible data center costs, related services, and electricity used by a certified qualified data center are exempt from state sales and use tax where the firm invests at least $100M within five years and pays at least $1M in aggregate annualized in-state compensation over the first two calendar years of operation (a qualified large data center across nonadjacent fiber-linked sites requires $2B within ten years and $3M in compensation); crypto-mining facilities are excluded, certification is by the Department of Finance and Administration after a positive AEDC cost-benefit analysis, and no sunset date is stated.
Recent change: Act 548 of 2025 (effective October 1, 2025) lowered the investment threshold from $500M to $100M, added the qualified large data center category, excluded crypto mining, and moved administration from AEDC to DFA; no 2026 fiscal session change found.
