Data center tax exemption in Florida

Florida data center property exemption (Fla. Stat. 212.08(5)(r))

Data center property, including construction materials, equipment, servers, software and electricity used exclusively at the data center, is exempt from state sales and use tax for data centers built on or after July 1, 2017 whose owners and tenants make a cumulative capital investment of at least $150M and that have a critical IT load of 100 MW or more (and at least 1 MW per owner or tenant) within five years of construction start; permanent certificates are reviewed every five years, and no new temporary certificates may be issued after June 30, 2037.

Recent change: 2025 HB 7031 raised the critical IT load threshold from 15 MW to 100 MW effective August 1, 2025, without a grandfather clause for existing sub-100 MW centers.
