Data center tax exemption in Georgia

Georgia high-technology data center equipment sales and use tax exemption (O.C.G.A. 48-8-3(68.1))

State and local sales and use tax exemption for high-technology data center equipment and certain construction materials (not electricity) at certified data centers; minimum aggregate expenditures over any consecutive seven-year period are tiered by county population: $250 million and 25 new quality jobs (over 50,000 residents), $75 million and 10 jobs (30,001-50,000), or $25 million and 5 jobs (30,000 or fewer); the exemption covers purchases through December 31, 2031, and the paragraph is repealed January 1, 2032.

Recent change: A 2024 bill (HB 1192) to pause new certificates was vetoed by Gov. Kemp; in 2026 the Senate pursued repeal (SB 410) but the House left the exemption out of its tax package, so it survived the session unchanged.
