Data center tax exemption in Massachusetts
Massachusetts qualified data center sales and use tax exemption (M.G.L. c. 64H, s. 6(zz); c. 23A, s. 70; 400 CMR 9.00)
Twenty-year sales and use tax exemption for eligible data center equipment, software, electricity and construction costs at EOED-certified facilities of at least 100,000 sq ft that incur at least $50 million in eligible costs within 10 years of certification and maintain at least 100 Massachusetts jobs; the state stopped accepting applications in June 2026 until further notice.
Recent change: Created by the 2024 Mass Leads Act (Chapter 238 of the Acts of 2024); on June 25, 2026 Gov. Healey put a hold on applications until further notice, pending protections against higher energy bills, and issued a framework expecting projects to bring their own clean energy.
