Data center tax exemption in Oklahoma
Oklahoma computer services and data processing sales tax exemption (68 O.S. § 1357(21))
Machinery and equipment bought by data processing firms in SIC 7374 that derive at least 80% of annual gross revenue from out-of-state buyers (50% for SIC 7372 and 7373 firms) is exempt from sales and use tax through an annual affidavit filed with the Tax Commission; there is no minimum investment, job requirement or sunset, and electricity is not covered (Oklahoma Commerce notes a separate exemption for web search portals that does include electricity).
Recent change: September 30, 2026: a draft Incentive Evaluation Commission review recommended retaining the exemption with modifications, such as tracking the value of exempt purchases and considering new conditions; no statutory change found.
